In This Post We Will Learn About Drone & How To Get Licence For Drones In India. What Is Law And Order Related To Drones Use In India And What Is the Process Of Drone Registration In India?

The Directorate General of Civil Aviation has issued the Civil Aviation Requirements (CAR) for civil use of Remotely Piloted Aircraft System (RPAS) commonly known as a drone. Drone policy and Law-order will be effective from 1st December 2018.

After much deliberation, the Director General of Civil Aviation ended the ambiguity and confusion on the use of Drone. The government has unveiled regulations that will finally allow for legal drone operations in India.

Many precautions have to be kept in mind to operate a drone in India. guidelines prepared in this regard by the Ministry of Civil Aviation. Before using drone you have to register yourself with your drone on the digital sky platform.

According to the Civil Aviation Minister Suresh Prabhu, the drone has brought revolution in the aviation sector and its better use will help resolve many problems.

Type Of Drone

Drones are divided into 5 categories:-

  • Nano- Drone less than or is equal to 250 grams.
  • Micro- Drone ranges from 250 grams to 2kg.
  • Small- Drone is between 2 kg and 25 kg.
  • Medium- Drone varies from 25 kilograms to 150 kilograms.
  • Large- Drone more than one 150 kilograms.

All drone other than nano variety will have to register on digital sky platform. after registration drone, the owner will get a Unique Identification number.

Drone regulation Authority  Specified Three Zones For Drone- “Red, Yellow and Green“.

Drones are not allowed to fly in the red zone. the yellow zone delineates control a space. The Green Zone is uncontrolled airspace to use the Drone. If you want to fly a drone in the green zone the mobile app will help you to get permission from your near police station.

Without digital permission, the drone will not be able to take off. “Digital-Sky Platform” will be connected to district police headquarters and there will be a digital provision for any permission.

No Drone Zone In India (Law 2018)

The New regulation prohibited drone flying near the airports, domestic airports, International borders, secretariat premises, police station, railway station, hospitals, etc.

A drone can’t fly over strategic places, important military establishments and areas around Vijay Chowk in Delhi.

  • You can’t fly drone within 5 km (2.7 NM) radius from Aerodrome Reference Point (ARP) of the operational aerodrome.
  • People can’t fly drones within 50 km of the international border which includes The line of Control (LoC), Line of Actual Control (LAC) and Actual Ground Position Line (AGPL).
  • Beyond 500 m (horizontal) into the sea from the coastline provided the location of the ground station is on a fixed platform over land.
  • You can’t fly drones within 5 km radius from Vijay Chowk in Delhi
  • Please never fly drones from moving vehicle, ship or aircraft it is also illegal.
  • Drones can’t fly over eco-sensitive zones around National Parks and Wildlife Sanctuaries without prior permission if you want to fly in this area you have to register yourself with your drones on digital sky platform.
  • You can only use Drone in daylight.

Expert says, there was no clarity on the use of drones, people had to face difficulties. but with the implementation of new rules, how to use a drone in India will change the scenario.

  • ड्रोन केवल दिन में ही उडाये जा सकेंगे जिसकी ऊंचाई 200 फीट से अधिक नहीं होगी।
  • ड्रोन के माध्यम से किसी भी तरह की खतरनाक सामग्री, पशु अथवा मानव को लाने या ले जाने की अनुमति नहीं है।
  • आपको अपने ड्रोन को डीजीसीए द्वारा पंजीकृत कराना होगा।
  • अगर आपके पास माइक्रो और इससे ऊपर की श्रेणियों के ड्रोन है तो दुर्घटना से बचने के लिए ड्रोन पे रेड लाइट का उपयोग करना होगा।

कहाँ-कहाँ आप ड्रोन नहीं उड़ा सकते है?

  • हवाई अड्डे से 5 किलो मीटर के क्षेत्र के भीतर आप ड्रोन नहीं उड़ा सकते है|
  • स्थाई अथवा प्रतिबंधित क्षेत्र में ड्रोन उड़ाना मना है|
  • जोखिम पूर्ण क्षेत्र ड्रोन का इस्तेमाल नहीं कर सकते है|
  • तटीय क्षेत्र से सटे समुद्र में 500 मीटर (क्षैतिज) से परे नहीं उड़ा सकते है|
  • अंतर्राष्ट्रीय सीमा से 50 किलो मीटर के क्षेत्र के अंदर भी ड्रोन नहीं उड़ाना है|
  • आपातकालीन अभियानों से जुड़े क्षेत्र में बिना आज्ञा के ड्रोन नही इस्तेमाल किया जा सकता है|
  • जनसुरक्षा को प्रभावित करने वाले क्षेत्र के निकट अथवा ऊपर और घनी आबादी वाले क्षेत्रों में बिना पूर्व अनुमति के नहीं उड़ाया जा सकता।
  • दिल्ली में विजय चौक से 5 किलो मीटर के दायरे में ड्रोन नहीं उड़ना है|
  • अगर आप यात्रा कर रहे है तो चल वाहन, पोत अथवा वायुयान से भी ड्रोन को संचालित नहीं किया जा सकता।

Eligibility For Drone Licence In India

There are also rules to get a licence for a drone.

  • Applicant must be 18 years old.
  • Drone pilot should have studied up to class 10th.
  • Applicant should have basic information about drones.

The central government says the commercial use of drones in areas like agriculture, health and disaster relief will be effective from 1st December 2018 but the supply of other items including food items will not be allowed at this moment.

According to the regulations, all civilian drone will be restricted to night operations and the flight will be limited to only those places where visibility will be good.

Registration Process Drone Licence

The registration process for drone licence in India will start from 1st December 2018 in DGCA official website while Operations of Remotely Piloted Aircraft System to be enabled through Digital Sky Platform.

The RPAS operations will be based on NPNT (No Permission, No Takeoff). So if you want to fly a drone as your selected area anywhere in India you need permission Digital Sky Platform. this platform will be interlinked with your near police station.

There will be different colour zones visible to the applicant while applying in the digital sky platform. first is Red Zone where flying not permitted, second is Yellow Zone (controlled airspace) where permission required before flying and third and last is Green Zone (uncontrolled airspace) automatic permission.

Step 2:– Click On Registration Link.
Step 3:– Enter Your Personal Details.
Step 4:– Enter Your Drone Details.

Note:- Drone Registration Link for a licence will be available on 1st December 2018.

 

What Happens If You Broke The Drone Law In India

  • Suspension/ cancellation of UIN/ UAOP in case of violation of regulatory provisions.
  • Actions as per relevant Sections of the Aircraft Act 1934, or Aircraft Rules, or any statutory provisions.
  • Penalties as per applicable IPCs (such as 287, 336, 337, 338, or any relevant section of IPC).

Drones are also being used to maintain law and order, some example are:-

Drone In Indian Railways

Recently, the Indian Railways took a major decision to increase the safety and efficiency of its services.

  • Drone cameras will now be used for infrastructure, monitoring project and also for track maintenance.
  • Railways will also use Drone camera is in all its divisions and Jones. Jabalpur headquarters was the first use Drone cameras and trial have already begun in Bhopal and Kota division.
  • India’s aviation regulator the Directorate General of Civil Aviation has finally unveiled dropped norms for drone usage. until now owing to safety concerns, it was illegal to fly drones in India without a note from the authorities.

Many e-commerce companies are planning to use Drone Technology. Google and Amazon are aiming to use drones to deliver goods and products. last year Amazon file for a patent to deploy Drone. it aims to deliver goods to households using drones.

Drone In Defence Sector

Drones Required By Indian Forces

  • According to the defence ministry’s “New technology perspective and capability roadmap report 2018”. the Indian armed forces require over 400 drones over the next decade.

 

  • These include combat and submarine-launched remotely piloted aircraft and also high energy lasers and high-powered microwave capable of destroying Enemies target and satellites.

 

  • The roadmap report says the country needs medium altitude, long endurance combat remotely piloted aircraft with the capability to fly up to 30000 feet altitude, extended satellite communication Rangers and endurance of more than 24 hours. Beside the drones should be capable of firing missiles at land and Maritime target from 20 km away.

Indian Drones

  • With an aim to increase indigenous development, the defence research and development organisation has developed UAV systems, that include Lakshya Nishant and Rustom 1 and 2. The First Flight of Rustom 1 took place on 16th November 2009.

 

  • Rustom-2 flew successfully in February 2018, it has been developed on the lines of the American Predator drones for used for all three services of the Indian armed forces.

 

  • A medium-altitude prototype, it can fly at over 22000 feet. it is a long endurance UAV that has an approximate flight time of 20 hours. currently, the DRDO is developing the “Ghatak stealth combat drones” under 2652 crore rupees project.

 

  • The defence ministry roadmap says the army and Navy need more than 30 combat remotely piloted aircraft and 100 to 150 medium attitudes long endurance fighters drone.

 

  • The Indian Navy also needs over 50 high altitude long endurance drones that can be launched vertically from a warship and as10 submarine-launched remotely piloted aircraft.

  • The Germans tested V1 flying bombs In 1942 around the same time the United States Army started using drones for targeting and training. The American B-17 flying Fortress flew from the air force base in California on August 6, 1946.

 

  • The U.S deployed a large number of unmanned aerial vehicles during the Vietnam War during. this time Drones were used to carry out reconnaissance activities.

 

  • The Drone was first used to kill in 2002, the CIA has been playing unarmed drones over Afghanistan since 2000. on February 4th 2002, the CIA first used an unmanned Predator Drone in Paktia province in Afghanistan. the intended target was Osama Bin Laden.

 

  • Surveillance programs worldwide are being done through American drones. Iran and Israel to develop the military and spy drones. in India DRDO and Hindustan Aeronautics Limited are developing many categories of Drones.
